I can’t say I’m at all surprised by this news. Anyone with half a brain has to wonder what Nifong was thinking to publicly pursue this case in the first place.
DNA testing conducted by a private lab in the Duke lacrosse rape case found genetic material from several males in the accuser’s body and her underwear _ but none from any team member, including the three charged with rape, according to a defense motion filed Wednesday.
The motion, signed by attorneys for defendants Reade Seligmann, Collin Finnerty and David Evans, complained that the information was not disclosed in a report on the testing prosecutors provided earlier this year to the defense.
“This is strong evidence of innocence in a case in which the accuser denied engaging in any sexual activity in the days before the alleged assault, told police she last had consensual sexual intercourse a week before the assault, and claimed that her attackers did not use condoms and ejaculated,” the motion read.
In an interview, defense attorney Joseph Cheshire said the report’s findings suggest the accuser had sex shortly before the March team party where she was hired to perform as a stripper. The woman has said three lacrosse team members gang-raped her in a bathroom at the party.
“None of (the DNA material) happens to be from lacrosse players who are supposed to have had sex with her, which is pretty significant,” said Cheshire, who represents Evans.

Just playing devil’s advocate here, but wouldn’t condom usage prevent the transfer of genetic material? In a rape case involving one victim and one accuser, the idea of condom usage might seem implausible. But considering that the accuser is alleging 3 individuals participated in the rape, I think that could be a possibility.

After some current events during the past year, it’s becoming clear we need to be more concerned about over zealous prosecutors. I’m reading the latest John Grisham book, A true story about a man on death row for 11 years. He was unfairly tried and found guilty. For most of my life I’ve been gung ho behind the cops and prosecutors but damn, we need to look more closely at cases like the Duke rape investigation.
I live near Durham, and I have no idea how Mike Nifong got re-elected DA. Everyone I know was skeptical of the stripper’s story.

I wonder how this would play out, if it wasn’t for the fact that DNA testing is available.
That said, I think part of the problem is that all too often the adversaries in criminal cases think they are playing a game, where one of them must “win” rather than actually seeking to see justice done.
Nifong’s case has been crumbling around him for months-it had gaping holes at the beginning and those holes aren’t getting smaller. I don’t even see how he could go to trial with this-multiple sperm samples, none from the accused or any other player is the mantra the defense will be shouting, and that in and of itself spells reasonable doubt.

It’s an article of faith among the lower-case clan that women never lie about rape, and black are always the victims of whites… evidence be damned.
There is also a strain of thought on the left that even if the lacrosse players are innocent, they deserve to be prosecuted anyway in retribution for all the black men who were prosecuted in the past on false rape allegations. It kind of OJ-in-reverse.

I think there’s a lot more in the “sides” taken in the Nifong false prosecution case than might be represented on first reviews.
But then, in a world where Democrat Corruption is excused as “normal” or conventional by the MSM, how will the truth ever win out?

I didn’t resent frat boys or athletes in college. I dated them.
Unfortunately for Chase, as I pointed out in a post which got trapped by the spam filter, the alleged victim also TOLD the hospital nurse who saw her after the alleged assault that no condoms had been used.
Of course, the alleged victim has changed her story so many times already, what’s one more reverse?
But it’s like V the K and Matt pointed out; black woman accuses three white males from privileged backgrounds who are attending a prestigious private college and are athletes. In the eyes of leftists, Democrats, and gays like Chase, there’s no need for evidence and there’s no need to review the obvious; they’re guilty because of their skin color and their background.

This woman is clearly a liar. Her skin color does not and should not affect that fact. There needs to be criminal repercussions for this.
VthK, your post made me chuckle. This lefty was one of the few exceptions you included in “most” probably, as I was great friends with a lot of the football, baseball, basketball players (mand most others). I can honestly say though that I’ve never met a lacrosse player I liked. Every single one I met was simply an a$$hole. Must have been something with that particular sport.
That being said, these guys at Duke got (and continue to get) a raw deal.
Speaking of Duke, Hot Air is reporting (And backing it up with screencaps) that DemUnderground is frantically deleting posts from lefties expressing praise and support for David Duke at the Holocaust Conference.
