I feel you miss the point of the quote you gave, and are being unfair.

That was part of his dissent, yes?  So he&#039;s speaking &lt;i&gt;officially, as a judge&lt;/i&gt;.  Does he really need to say &#039;as a Supreme Court Justice&#039; in every sentence?  to rational people, no.

Even if it isn&#039;t the dissent (since you didn&#039;t provide a link, I&#039;m assuming it is) He&#039;s still sayng that he&#039;d not enforce his opinion on others.

Since he&#039;s speaking about what the Constitution says, and the Constitution is silent on the subject, your Koran argument is flawed at best, a straw man at worst.

What he is saying is that the Constitution of the United States is silent on the matter, thus leaving it up to the states, per the 10th ammendment.

Fun fact.  Laws don&#039;t have to be &#039;kind&#039; or &#039;nice&#039; or to be honest, &#039;fair&#039; as long as they&#039;re &lt;i&gt;legal&lt;/i&gt;.  The dissent says that as a citizen you may not like the law, and may want to change the law, &lt;i&gt;but that is not the job of the Supreme Court&lt;/i&gt;

Was the voting age of 21 &#039;fair&#039;? Enough people thought it wasn&#039;t that we had the 26th ammendment passed.  as Barry McGuire said &quot;Old enough to kill, but not for votin&#039;&quot;.  It didn&#039;t mean it was illegal, or that we should go back and let people who were 18 at the time of an election cast votes retroactively.  It meant that &lt;i&gt;the people, through the means provided by the Government we live under&lt;/i&gt; changed it.</description>

I feel so sorry for the people of his district that they have such low morals and self esteem that they consider Bawney an asset.</description>
