This Is Why Congress Protected Gun Manufacturers from Leftist Lawfare

Hillary and the rest of the Democrat Asylum are on the warpath to strip firearms manufacturers of protection from nuisance lawsuits. Basically, Democrats want gunmakers to be held liable for the criminal misuse of their products. Imagine, for example, if carmakers were liable for drunk drivers, or computer manufacturers were liable when someone used their laptop to access kiddie porn. The industry would go bankrupt, right? Democrats know this, which is why they want to open gun-makers up to these kinds of lawsuits. In fact, the industry was given that protection after anti-gun groups announced they were going to pursue exactly that strategy.

The left has learned that even when a target can win lawsuits, the expense of constantly fighting them will eventually force them to capitulate. This is known as “lawfare.” And as a result of lawfare, you will no longer be able to go to the circus to see the elephants.

The Ringling Bros. and Barnum & Bailey Circus is ending its elephant acts a year and a half early, and will retire all of its touring elephants in May.

But because so many cities and counties have passed “anti-circus” and “anti-elephant” ordinances, it became difficult to organize tours of three traveling circuses to 115 cities each year, Feld Entertainment CEO Kenneth Feld said last year. Fighting legislation in each jurisdiction is expensive, he said.

Never underestimate the power of insane zealots with oodles of money.

Just for the records, I dig elephants, and I want them to be treated well. And I am okay with a reasonable level of regulation to ensure their good treatment. That is not what the Animal Rights zealots wanted. In their view, animals performing in circuses is no different than human slavery. Because of their tireless zealotry, they were able to make their view prevail.

This is exactly why the anti-gun zealots need to be fought. They have made clear what their ultimate goal is, they are tireless zealots, and they are well-funded.

    And the animal rights zealots prevailed in the end despite that Ringling Bros. *won* their lawsuit against the major animal rights groups (HSUS, ASPCA).

    The AR interests won because they got others to do their dirty work for them by way of regulation that if it doesn’t prohibit animal use and ownership outright, makes it too expensive and difficult.

    On the same note, did you know that dog breeding is now illegal in most of California? That it is illegal to sell a puppy in Dallas, Texas? that only “rescues” can legally sell a dog in California, unless the transaction is performed in the privacy of your living room? It isn’t yet well-enforced, but it’s getting there.

    And the AR interests have enlisted the “rescue” industry (which, incidentally, breeds and sells dogs too) as useful idiots to do the campaigning against those wicked dog breeders, decried as the source of all evil and pet overpopulation. Meanwhile, rescues import over 300,000 dogs from overseas every year (1/3rd of all the dogs sold in the U.S.) — because there aren’t enough puppies to meet demand. But that can be shut off by new anti-shipping regulations at any time… just as it’s been made difficult for breeders to import or ship dogs.

    If you don’t want animals to become extinct have them be useful to man. Veal, steak, lobster, & ham will never go extinct but elephants natural habitats are being over run by “monkeys”

    Hey mikey it seems that Stormfront site you recommended has taken over the New York Times saying moslems must be deported from Germany or another Hitler will realize who is behind the destruction.

    Just for your edification, read the first chapter of The City Of Baraboo by Barry B. Longyear. It was exactly this type of regulation that caused the last circus on Earth to venture to the stars.

    Okay, I’ll bite. Let’s make those who produce something legally responsible for those who misuse their products.

    However, I suggest that we start with those who produce laws that are misused.

    In other words, let’s go after lawmakers who passed laws that make “sanctuary cities” a safe haven for illegal aliens who commit crimes.

    Then we can make judges and lawyers responsible for the actions of the criminals they get off.

    And, let’s end with the US and state congresses being held responsible for every act of fraud committed by welfare cheaters and US government contractors cheating the Feds.

    We would end up with a government which has politicians serving two terms – one in office , the second in jail.

    I recently met a lawyer of about my age whose practice is focused on product liability claims on goods manufactured in China. Whew! He has his hands full. Instead of waiting for the slow grinding millstones of the gods in the Department of Commerce to act, he goes straight to the Chinese and works out two settlements. The first is the $$$$ for his American clients to pay the claims. The second is to get the Chinese to stop the Chinese manufacturers from screwing up the products.

    You may recall a problem about ten years ago when pet food was killing the pets. It was caused by melamine in the food which caused renal failure. The brands involved included Alpo, Purina, Royal Canin, Blue Buffalo, Kirkland (Costco) and 45 more. The food was manufactured in the United States, but the vegetable proteins were sourced from China. Why? Because no manufacturer remained in the US for gluten. Gluten is the “glue” found in most grains which helps bind the flour and hold the shape of the “kibbles” and “bits” and make the product “chewy.”

    We had become aware that some human are gluten intolerant. We went “gluten free” crazy. One bit of research suspected that gluten and carbohydrates are the root cause of Alzheimer’s, anxiety, depression, etc. Gwyneth Paltrow squawked about detoxing by abstaining from soy, caffeine and gluten.

    Why was there no gluten processor left in the US? It was a niche business and it came under fire.

    Now, here is the crazy part. Guess what? Dogs and cats have different guts from humans. Who would have guessed? It wasn’t the gluten in the pet food, it was the additives which was killing the pets. The Chinese manufacturers were adding melamine to the gluten in order to increase the apparent protein content. It cost them little and it only made them few pennies, but cutting corners is often the only way to make a profit in China.

    This lawyer I mentioned convinced the Chinese government to pay the claims and to police the industry. It has taken years for the Chinese to come around to searching out problems before they arise. The effect of this scrutiny has been rising prices in manufacturing and more expensive Chinese goods.

    The moral of this tale is that it was capitalism which made the Chinese pay attention. When, say, Alpo was sued in the US, Alpo passed the costs on to the supplier. Since the supplier was Chinese, Alpo had to get standing in the Chinese legal system in order to collect. Since Alpo had no other supplier to fall back on, it was critical for it to get its Chinese supplier to play fair and cut out the melamine additive.

    This was not done by treaties and trips by Hillary Clinton or John Kerry. It was done by lawyers and bankers talking dollars and cents and convincing the Chinese that it was in their own best interest to clean up the mess.

    The other moral to this tale is how silly fads can put manufacturers out of business. Gluten-free has become as goofy as “organic” is in labeling. I alway smile when I see the “organic” carrots at the grocery store. I immediately look around for the “inorganic” carrots.

    If you are affected by problems created by gluten or peanut oil or lactose, you are already on notice to be cautious. There might be as many as 20 million people in the US that have gluten reactions. That leaves about 300 million who do not. Yet you would think from all the “gluten-free” packaging that gluten is like the norovirus lurking on the grocery shelves.

    When Donald Trump brags that he knows how to negotiate, he is actually saying he knows how to talk dollars and cents in a way that makes sense.

    Recently, I learned that the Thai’s are using “slave labor” to peel and devein shrimp for the American market. So, now, apparently, liberals are demanding that the their fishmonger at Whole Foods lie to them about the social justice purity of their shrimp. If these prissy liberals had any concept of what makes meat halal meat, they might start insisting that Islam go vegan.

    I am a great fan of elephants in the wild and elephants in captivity. Natually, I prefer my elephants to be well cared for and healthy. Many centuries ago, man discovered that his puny self could control the mighty elephant. He could even teach the elephant to amuse him.

    The African elephant eats about two-thirds of a ton of vegetation a day and drinks prodigious amounts of water. Eventually, an arthritic and tired 5,500 pound eating machine just can’t keep up the pace of stoking the stomach and it literally starves to death. In fact, the elephant is a very inefficient eating machine.

    To my way of thinking, when the circus no longer has elephants, it is no longer a circus. And, maybe it is time for the circus to die out. There is no reason for elephants to be continually subjected to the elephant stick any more than for Budweiser to constantly whip their Clydesdales.

    Ringling Brothers is going to “pasture” their small herd of elephants on a couple hundred acres of land in Florida. If the elephants have to forage that land to survive, they will decimate it very quickly. So, Ringling Brothers is going to have to feed these giants until they die in confined captivity. Just another zoo where people come to look at what remains of a once wild creature.

    I guess I don’t get it. All over the U.S. we have little pods of one or two elephants slopping around existing. Most of the tigers in the world are in public zoos and private compounds. Why? Because their habitat is shrinking and they don’t behave well in proximity to man.

    So, we “preserve” them by cooping them up and that is supposed to be humane. But if we preserve them as useful workers or entertainment, that is not OK?

    There is a group of dog(most terrier breeds) owner in New York City who take the dogs on rat hunts. These ratters thoroughly enjoy the outing and they tear into a pile of rats in the typical outing. When will the PETA folks charge forth and go ballistic about humans making dogs be cruel to rats?

    Really, we do have the topsy-turvy world Alice found in Wonderland.
