“Whoever, being entrusted with or having lawful possession or control of any document … relating to the national defense, (1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed, or (2) having knowledge that the same has been illegally removed from its proper place of custody or delivered to anyone in violation of its trust, or lost, or stolen, abstracted, or destroyed, and fails to make prompt report of such loss, theft, abstraction, or destruction to his superior officer —
Shall be fined under this title or imprisoned not more than ten years, or both” 18 USC 793 (f)

    This has to be one of the most disappointing episodes in our history. The language in the statute is clear (although HRC and her cronies demonstrated intent). There are people serving time in prison for mishandling sensitive materials on much smaller scale. I’d bet a week’s pay that Putin (and China, Germany, the UK, Israel, Iran, North Korea, New Zealand, the Vatican…) have scads of intel gleaned from HRC’s servers.

    Bill meets with the AG: Hillary’s campaign states that they’d like to retain Lynch; BHO heads off, on AF1 within minutes of Comey’s to campaign with Hillary…

    It used to be that they put on a pretense of the “rule of law” thing but now they don’t even try. It’s a big middle finger.

    As bad and as career ending as an indictment would be for Hillary, the fallout will only solidify and mobilize opposition thereby assuring her defeat. We are so fed up w/ the brazen shenanigans! This will immortalize her in the history books as craven, corrupt & criminal U.S. politician ever!

    She is an unredeemable and most contemptible figure in American politics. No way will she ever gain the respect of the American public.

    Does that mean that there can be no more prosecutions for mis-handling classified information anymore unless the document is handed directly to a non-Islamic enemy? Will those prosecuted, or being prosecuted, be able to get off now?

    TheQuietMan, no, since no trial was held. If Trump wins in November, he could easily clean house, have his new AG look at the FBI files and decide differently.

    Hillary’s only out then would be a BHO pardon, which would stink so highly, I would bring HIM up on charges of obstruction of Justice, since Hillary could run for Senate again, if she wanted. I want her gone, gone, gone.

    #5 Now you know how important it is that he receive every possible legitimate non-Hillary vote. If she gets in, all this might be buried… possibly forever.

    The only ones who might save you now are Julian Assange and Vladimir Putin (if in fact he has what hd claims to have). The trick is to release it early enough to achieve public consciousness and do the required damage, but too late for her to do successful damage control.

    The MSM will spin the story, emphasizing that the investigation found no proof of criminal intent. Which is not quite the point.

    The relevant law in the email scandal does not require criminal intent, just “gross negligence,” for guilt. The FBI effectively rewrote the law, adding an “intent” requirement that was not part of the original statute.

    It’s as if you were driving recklessly and accidentally killed someone, and you were charged with manslaughter or vehicular homicide. Then the judge (your brother-in-law) dismissed the case, after re-interpreting the law so that proof of recklessness was not enough, and the prosecutor would have to prove that you intended to kill the victim.

    The fix was in from the beginning. The FBI director and agents are employees, with mortgages to pay and families to support. They don’t dare displease the POTUS or the AG.

    Besides, Hillary’s supporters don’t care, anyway. They would vote for her if she had sold Omar Mateen the weapons that he used in the Orlando massacre. They would support her if they saw her deliberately drown a baby in a bathtub.

    To them, only two things matter. One, it’s time for a token female president. Two, and probably more important, most of them want more and more Free Stuff from the government. And they can count on Hillary to keep filling the trough.

    The first person who is accused of violating some obscure regulation, attempts to employ the Clinton defense, fails, and points out that she only got away with it because she could bring more force to bear like some despotic tribal queen, and thus unfit of the title of “President,” should be hailed as “Ultimum Romanorum,” just as the signers of the Declaration, veterans of the Revolution, and establishers of the Constitution were in the 19th century.

    Craig Smith (#5). I should have been more clear–serious lack of sleep and I apologize. I meant can the “the little people” who handle, and potentially mis-handle, classified information now get off if they are accused of similar crimes.

    But I do like your idea of the next non-democrat President having her case reviewed with an eye for her prosecution.

    In a nutshell: It’s too depressing. No kidding. The Clintons are, between them, the most sordid people that I have ever seen in American politics. Their continued prosperity is, in itself, a major signal of America’s decline.

    Liberty and justice for all, is now a meaningless phrase. It is available only to the chosen few, the elites. Anybody entering politics with the motive to enrich themselves without condemnation should study the Clintons. They have turned corruption into an art or science. For a couple that supposedy left the White House broke, own at least to large homes, an office or office building in Harlem and in general are rolling in dough. What a mistake I made buying the audio course from Trump University on How to Build a Fortune. The Clinton Foundation should créate a course in How I Made a Fortune in Corruption. It might sell like hotcakes.

    FBI Director Comey said,” …[Secy. Clinton] didn’t lie under oath” to the FBI.

    It’s now revealed that Sec. Clinton wasn’t questioned under-oath to begin with, and there’s no recording or transcript of her “interview”. And FBI Director Comey didn’t directly-speak to the Special Agents who actually interviewed her either.
